Today is the Global Information Governance Day! #GIGD occurs on the third Thursday in February and was established to raise the awareness of information governance.

WHAT IS INFORMATION GOVERNANCE (IG)?

IG is the activities and technologies that organisations employ to maximise the value of their information while minimising associated risks and costs.

IG is a holistic approach to managing corporate information by implementing processes, roles, controls and metrics that treat information as a valuable business asset:

  • to make information assets available to those who need it
  • to provide employees with data they can trust and easily access while making business decisions
  • to reduce the legal risks associated with unmanaged or inconsistently managed information

The information governance, after a preliminary analysis, results in a classification of different value levels of your information. The outcome of this classification is the identification of your information with engaging/probative/legal value. (for instance business contracts, policies…)

Breaking news on information governance in Europe – Trusted service provider for legal documents Labgroup first PSDC to be certified – #Archiving2.0

Since three millennia, the archiving of the writings is inseparable from its paper support. However, technological advances make it possible to perform native electronic records and to dematerialise paper documents.

The European regulation eIDAS (Electronic Identification and Trust Services) 910/2014, which has been fully implemented since the 1st of July 2016, has clearly demonstrated the willingness of member states to consider these technological advances and democratise digitisation by:

  • enhancing the security of electronic exchanges;
  • recognizing the universal value of the electronic signature;
  • granting the legal value to a digital document.

In Luxembourg the legal framework anticipates and supports this democratisation of the digitisation. The law of 25th of July 2015 on electronic archiving recognises the probative value of electronic copies of paper documents produced by a PSDC (Provider of Digitisation and Conservation Services) certified company to respect all the conditions of strict fidelity to the original and, moreover, presumption of conformity with the original.

As being the first company which is certified PSDC-DC in Luxembourg, Labgroup is certified as:

  • Provider of Digitisation Services, in other words, Labgroup is empowered to create legal electronic copies of paper documents;
  • Provider of Conservation Services, which guarantees the integrity, confidentiality and persistence of electronic archives throughout their retention period.

What is the value of the PSDC status abroad? While Luxembourg has been a precursor to this new law, other countries have also embarked on the path of digital transformation by introducing an attractive legal regime for electronic archiving. However, no other country engages the state through the certification of service providers, such as the PSDC status in Luxembourg.

By archiving in Luxembourg, companies in Belgium or France could therefore both exploit their national legislation and benefit from the guarantees offered by the PSDC status.

On 1 February 2017, Deputy Prime Minister and Minister of the Economy, Etienne Schneider presented the first accredited certification body and first certified service provided in electronic archiving.

Currently, Luxembourg is the only country in the European Union with an operational legal framework for electronic archiving. Consistent with the Digital Lëtzebuerg initiative, the current legislation recognizes in particular the legal value of digital documents and, under certain conditions, offers important guarantees as to their conformity with the original. In addition, this legislation provides for a new statute called ‘dematerialisation or conservation service provider’ (CSDP) for companies active in the field of electronic archiving.

Yesterday, Minister Schneider attended the accreditation by the ILNAS (Institut Luxembourgeois de la Normalisation, de l’Accréditation, de la Sécurité) of PECB Europe as the first certifying body for electronic archiving in Luxembourg and the certification of LabGroup Luxembourg as the leading provider of dematerialisation or conservation services (CSDP).

In his introduction Etienne Schneider stressed that: “With electronic archiving and the status of CSDP we are taking a step further in the transposition of our Digital Lëtzebuerg strategy and we will be able to attract new economic players in Luxembourg, whether they are companies active in electronic archiving or companies wishing to take advantage of our reference legislation for the electronic archiving of their own documents.”

Lab Luxembourg SA (Labgroup) is the first PSDC to be certified in Luxembourg

At a press conference held at the Ministry of the Economy on Wednesday 1st of February, Étienne SCHNEIDER, Deputy Prime Minister & Minister of the Economy, Jean-Marie REIFF, Director of ILNAS (Luxembourg Institute for Standardisation, Accreditation, Security and Quality for Products and Services) and Bernard MOREAU, CEO of Labgroup, marked the start of Archiving 2.0.

Indeed, the certification of the first PSDC (Provider of Digitisation and Conservation Services), concretises the implementation of the law of the 25th of July 2015 on electronic archiving, and the establishment of the digital trust chain, which extends from the European Union to the holder of information, through the Luxembourg State and the third-party archiver.


PSDC certification, a long-standing work

As a third-party archiver for 40 years in Luxembourg, Labgroup had to prepare itself for the future by initiating its digital transformation in the early years of the 21st century. The strategy aimed to be the leading edge in the evolution towards a paperless society (or, in the medium term, with less paper). In parallel with investing in a state-of-the-art, highly protected storage and archiving infrastructure, Labgroup has developed a comprehensive and continuously improved Information Security Management System (ISMS).

These efforts to control risks were rewarded in 2014 by obtaining the ISO 27001 international certification (already a first for an archiver in Luxembourg), in terms of information security management covering all related activities (digitisation, physical and electronic archiving). With this first step achieved, it remained to obtain the new status of PSDC, created by the law of 25th July 2015 on electronic archiving.

As the first candidate, Labgroup was logically the first company whose processes and procedures conformed to the requirements of the PSDC standard, Labgroup was audited in November 2016. Following the positive verdict of the certifying body, ILNAS placed Labgroup on the list of legal persons with the status of PSDC under the number 2016/9/001 and implemented immediate supervision for which the institute is responsible.

Note that Labgroup is certified as:

  • Provider of Digitisation Services, in other words, Labgroup is empowered to create legal electronic copies of paper documents;
  • Provider of Conservation Services, which guarantees the integrity, confidentiality and persistence of electronic archives throughout their retention period.

This achievement, on the 40th year anniversary of the company’s creation, marks the beginning of a new era of growth for Labgroup!

Legal archiving, a trusted service.

Whether as a consumer or a company, we archive information to be able to (well) defend our own interests in the future, for example, our health in the case of medical data.

Since three millennia, the archiving of the writings is inseparable from its paper support. However, technological advances now make it possible to perform native electronic records, such as purchasing on an e-commerce site, and to dematerialise paper documents, such as signed contracts in a handwritten manner.

The legislator has considered these advances by creating a legal framework that anticipates and supports the irresistible digitisation of our society. The law of 25th of July 2015 on electronic archiving therefore recognises the probative value of electronic copies of paper documents produced by a PSDC certified company to respect all the conditions of strict fidelity to the original and, moreover, the presumption of conformity with the original.

It is therefore with confidence, with the guarantee of the state, that the holders of information can now choose between:

  • continuing to outsource their paper records with Labgroup, or
  • requesting Labgroup to digitise their paper archives, then destroy them and only keep the electronic copies.

In either case, Labgroup will proceed as required by the law and as schematised here below.

In order to strengthen citizens’ digital trust, the law stipulates that PSDC’s must provide its clients with a well-documented prior information package before the signing of any service contract. This documentation must be kept available by Labgroup.

Electronic archiving, an opportunity for Luxembourg

Indeed, the rules and requirements to which Labgroup must comply as a PSDC are equivalent to those established by the Belgian law of July 21, 2016, called Digital Act, and the French decree of December 5, 2016 on the reliability of the copies and taken for the application of Article 1379 of the Civil Code.

The French and Belgian judges will therefore find, in the certified conformity of the PSDC in Luxembourg, objective reasons to rule favourably on the reliability of the digital copy.

Luxemburg ist das erste europäische Land, das den Weg zu elektronischen Dokumenten mit dem gleichen Beweiswert wie die Papierversion ebnet. Lab Luxembourg ist nun das erste Unternehmen, das ganz offiziell die 100-seitigen technischen Regeln erfüllt, die die Echtheit der digitalen Dokumente garantieren.

Anderthalb Jahre nach dem Gesetz zur elektronischen Archivierung kommt das damals geschaffene Statut des “Prestataire de service de dématérialisation et de conservation” (PSDC) zum ersten Mal zu Einsatz. Neben Lab Luxembourg ist mit Numen Europe in Howald ein zweiter Dienstleister dabei, die Prozedur zur Zertifizierung abzuschließen, bestätigte der beigeordnete Generaldirektor David Gray auf Nachfrage. Die Archivierungsdienstleister dürfen damit Kunden, die Digitalisierung und Speicherung anbieten.

“Nach dem Gesetz von Juli 2015 ist damit ein wichtiger Schritt für die Luxemburger Wirtschaft getan”, betonte Wirtschaftsminister Etienne Schneider. Er spricht von einem weiteren Standortvorteil, weil kein anderes Land ein solch klaren und sicheren rechtlichen Rahmen biete. Für Finanzakteure sei das ein Argument, um sich nach dem Brexit am hiesigen Finanzplatz niederzulassen, meint der Minister.

Ein Stockwerk weniger: Das ist der konkrete Vorteil, den eine große Bank aus der elektronischen Archivierung ziehen könne, so Schneider. Bisher müssen etwa Banken alle ihre Unterlagen während zehn Jahren auf Papier aufbewahren – sprich wahre Papierberge entstehen.

Le Luxembourg est le seul pays dans l’UE actuellement doté d’un cadre légal opérationnel relatif à l’archivage électronique. En cohérence avec l’initiative Digital Lëtzebuerg, la législation en vigueur reconnaît notamment la valeur juridique des documents numériques et, sous certaines conditions, offre des garanties importantes quant à leur conformité à l’original. En outre, cette législation prévoit un nouveau statut appelé «prestataire de service de dématérialisation ou de conservation» (PSDC) pour les entreprises actives dans le domaine de l’archivage électronique.

En date du 1er février 2017, Étienne Schneider, Vice-Premier ministre, ministre de l’Économie, a assisté à l’accréditation par l’ILNAS de PECB Europe en tant que premier organisme certificateur en matière d’archivage électronique au Luxembourg ainsi qu’à la certification de LabGroup Luxembourg S.A. en tant que première entreprise prestataire de services de dématérialisation ou de conservation (PSDC).

Dans son introduction Étienne Schneider, Vice-Premier ministre, ministre de l’Économie a souligné que: «Avec l’archivage électronique et le statut de PSDC nous faisons un pas de plus dans la transposition de notre stratégie Digital Lëtzebuerg et nous allons pouvoir attirer de nouveaux acteurs économiques au Luxembourg, que ce soient des sociétés actives dans l’archivage électronique ou bien des sociétés qui souhaitent profiter de notre législation de référence pour l’archivage électronique de leurs propres documents.»

Le ministre de l’Économie et l’Ilnas ont présenté mercredi le tout premier prestataire de services de dématérialisation ou de conservation (PSDC), Labgroup, ainsi que le premier organisme certificateur, PECB Europe. Après les PSF et les PSA, prestataires de services du secteur financier et des assurances, un nouveau métier certifié vient de faire son entrée sur le marché luxembourgeois: le PSDC. La concrétisation de 18 mois de travail après l’adoption en juillet 2015 de la loi sur l’archivage électronique élaborée par le ministère de l’Économie.

«Le Luxembourg est le premier pays de l’UE à se doter d’un standard, d’un cadre spécifique avec des règles contraignantes», souligne le vice-Premier ministre et ministre de l’Économie, Étienne Schneider. Mieux qu’un «early adopter», le Grand-Duché se positionne comme un «first mover» dans un domaine que la législation européenne n’a pas encore embrassé et enfonce le clou de sa stratégie Digital Lëtzebuerg.

Il s’est en réalité appuyé sur le règlement européen sur l’identification électronique et les services de confiance pour les transactions électroniques au sein du marché intérieur publié en 2014. Tout en allant plus loin puisqu’aucun pays n’avait encore forgé de cadre légal garantissant que le document archivé électroniquement a la même valeur que son original papier.
